Work Permits in Canada:
Open vs. Closed Work Permits

Canada offers two main types of work permits for foreign nationals: open work permits and closed work permits. These permits allow individuals to work legally in Canada, but each type comes with specific conditions.

Open Work Permit

If your spouse or common-law partner is currently working or studying in Canada, or if they have applied to sponsor you for permanent residency, you may be eligible for an open work permit. This type of permit allows you to work for any employer, anywhere in Canada, without needing a job offer.

Eligibility

  • Your spouse or common-law partner must be a valid work or study permit holder, or a Canadian citizen or permanent resident who has applied to sponsor you for permanent residency

  • You must provide proof of your relationship and your partner’s status in Canada

Required Documents:

  •  A valid passport

  • Proof of your spouse or partner’s status in Canada (study permit, work permit, PR card, or citizenship certificate)

  • Proof of your spouse or partner’s employment or studies in Canada (employment letter, pay stubs, or enrollment documents)

  • Proof of your relationship, such as a marriage certificate or proof of cohabitation for common-law partners

The spousal open work permit is an excellent opportunity for spouses or common-law partners to work in Canada while their partner studies, works, or awaits the outcome of a permanent residency application. This permit is typically issued for the same length of time as your partner’s permit.

Work Anywhere with Any Employer

An open work permit allows foreign nationals to work for any employer, in any job, across Canada. It is not tied to a specific job or employer, offering maximum flexibility to the permit holder. Open work permits are often granted to spouses or common-law partners of temporary permit holders, international graduates, and certain other categories of applicants.

Who can apply for an open work permit?

  • International graduates eligible for a Post-Graduation Work Permit (PGWP)

  • Spouses or common-law partners of Canadian work or study permit holders

  • Individuals who have applied for permanent residence and are awaiting a decision

  • Refugees, protected persons, and vulnerable workers in specific circumstances
